Is it saying that the guy's lawyers claim:
Some laws passed when Queen Victoria was in power don't apply in this circumstance?
Some laws in the state of Victoria in .au don't apply etc.
I'm guessing the former since it refers to "British citizens" later on
So why mention "Victorian laws"?
Did we have laws against race-hate crimes back then?
Is it just the "soliciting to murder" part that is covered by a very old law?

So it's Victorian age rather than state.
Looks like the racial hatred bit is covered by a different set of laws though.
